Alert: HB 2530
CONTACT HOUSE JUDICIARY
COMMITTEE MEMBERS AND ASK THEM TO INCLUDE VETERINARIANS
IN THE PROVISIONS OF HB
2530
On Friday, Jan. 9, the Kansas Supreme
Court found in favor of a plaintiff who sued her physician
for misrepresentation under the Kansas Consumer Protection
Act.
The Kansas Supreme Court decision effectively
means that physicians are subject to claims under
the Kansas Consumer Protection Act.
Gary Reser of the KVMA staff
and Greg Dennis, KVMA legal counsel, have identified
the introduction of HB
2530, which would negate physicians
being subject to claims under the Act.
Reser and Dennis believe the proposed exemption from
the reach of the Act should not be limited to just
physicians and human health care workers, but should
also include veterinarians.
Reser and Dennis are preparing testimony
to present to the House Judiciary Committee at
3:30 p.m. Thursday, March 1 asking them to include
veterinarians in the proposal.
The testimony will outline the crucial
role veterinarians play in human health, explain that
veterinarians are already highly regulated in this
area by a number of Kansas and Federal statutes, and
offer an amendment that would define "health
care provider" as a facility licensed by
nine state regulatory agencies, including the Kansas
Board of Veterinary Examiners.

ask them to include veterinarians in the provisions
of HB

AVMA REQUESTS KVMA MEMBERS

NATIONAL VETERINARY MEDICAL SERVICE ACT
The AVMA has requested that KVMA members
contact U.S. Sen. Pat Roberts and ask him to
support the National Veterinary Medical Service Act.
The following is an example of an appropriate

own words:
Senator Roberts, please support funding
and development of the National Veterinary Medical Service
Act (NVMSA), a program that will alleviate shortages
of veterinarians in rural communities and also improve
our country's preparedness for a major animal disease
outbreak. Dr. Nichols of the AVMA is coordinating current
activities to promote NVMSA. Please contact him at 202-289-3204
to find out what you can do to help support NVMSA. Thank
